Under Australian Road Legislation a moped and motorcycle (scooter) are defined as:
Moped: 2 wheeler motorcycle with a motor capacity that does not exceed 50cc (ICE) or 4000W (EV) and a maximum speed of 50 km/h.
Motorcycle (Scooter): 2 wheeled motorcycle with a motor capacity typically larger than 50cc (ICE) or 4000W (EV) and can exceed speeds of 50 km/h.
Fun fact: Even if the vehicle meets the capacity/power criteria but the vehicle exceeds the 50km/h limit then this is regarded a motorcycle/scooter and will be required to meet different rules for ADR (Australia Design Rules) compliance and licensing.
Licence required to use an electric moped in Western Australia
To ride a moped in Western Australia you need to meet the following criteria:
Age requirement: Be at least 16 years old.
Licence requirement:
Hold a valid moped licence (R-N class),
Hold a valid driver's licence (any class), OR
Obtain a motorcycle learner's permit
If you don’t have any prior riding experience, it’s always a good idea to familiarise yourself with the road rules specific to mopeds, scooters and motorcycles to ensure your safety and the safety of others. Western Australia is the only state and territory in Australia where you are able to gain a moped only licence at the age of 16 years old a full year prior to being able to obtain a car licence.

To legally ride a scooter above 50cc, you must have a motorcycle licence in Western Australia. If you don’t already have a motorcycle licence you have to complete the following steps:
Get your learner's permit
Sit the theory test
Learn to ride
Sit the hazard perception test
Take the practical driving assessment
Riding on your P plates
