Under Australian Road Legislation these vehicles are defined as:
Moped: 2 wheeler motorcycle with a motor capacity that does not exceed 50cc (ICE) or 4000W (EV) and a maximum speed of 50 km/h.
Motorcycle (Scooter): 2 wheeled motorcycle with a motor capacity typically larger than 50cc (ICE) or 4000W (EV) and can exceed speeds of 50 km/h.
Fun fact: Even if the vehicle meets the capacity/power criteria but the vehicle exceeds the 50km/h limit then this is regarded a motorcycle/scooter and will be required to meet different rules for ADR (Australia Design Rules) compliance and licensing.
Licence required to use an electric moped in the Australian Capital Territory
To ride a moped in the ACT, you need to hold an ACT motorcycle licence. Unlike some other states in Australia where you can ride a moped with a car licence, in ACT you cannot.
Licence required to use an electric scooter in the Australian Capital Territory
To legally ride a scooter in the ACT, you must have an ACT motorcycle licence. To get an ACT learner motorcycle licence you must:
Be at least 16 years and 9 months old
If you don’t already hold an ACT driver licence, complete a Pre-Learner licence course and pass the ACT Road Rules test
Successfully complete a Pre-Learner Licence Course (including a computerised knowledge test)
Then, go to an Access Canberra Service Centre within a month of passing the Pre-Learner course to get your motorcycle learner licence
From here you can progress to a provisional licence then finally your full motorcycle licence in due time.
